High-Risk Waiver, Assumption of Risk, and Informed Consent Agreement

This High-Risk Waiver, Assumption of Risk, and Informed Consent Agreement ("Agreement") is executed by the user/subscriber ("User") in favor of First Aid Fleet, its proprietors, directors, employees, consultants, representatives, medical advisors, affiliates, agents, and service providers (collectively, the "Company").

By registering, subscribing, initiating a call, sending a message, or otherwise using the services of First Aid Fleet, the User voluntarily acknowledges, understands, and agrees as follows:

1. The User understands that First Aid Fleet provides remote, subscription-based first aid guidance and general health advisory services through telephone, chat, or digital communication platforms. The services are provided without physical examination, diagnostic testing, laboratory investigation, imaging studies, or in-person clinical evaluation. The User acknowledges that remote advisory services inherently involve limitations, uncertainty, and potential risks due to reliance solely on information communicated by the User.
2. The User expressly understands that the services are informational and preventive in nature and do not constitute medical diagnosis, prescription, definitive treatment, or hospital care. No doctor-patient relationship is created by use of the platform. The Company does not undertake responsibility as a treating physician or healthcare provider for the User.
3. The User acknowledges that medical conditions may worsen rapidly and unpredictably. Remote guidance may not identify serious or life-threatening conditions. There is an inherent risk that symptoms described remotely may be incomplete, inaccurate, misunderstood, or insufficient for proper assessment. The User accepts that reliance on remote guidance carries the risk of misdiagnosis, delayed diagnosis, delayed treatment, incorrect interpretation, or medical deterioration.
4. The User expressly agrees that First Aid Fleet is not an emergency service provider and does not provide ambulance dispatch, emergency rescue, ICU care, trauma response, hospitalization, or physical medical intervention. In the event of severe symptoms, medical emergency, chest pain, breathing difficulty, stroke-like symptoms, uncontrolled bleeding, seizures, unconsciousness, or any life-threatening condition, the User agrees to immediately contact the nearest hospital, registered medical practitioner, ambulance service, or government emergency helpline without relying on the platform. The User assumes full responsibility for seeking emergency care when required.
5. The User knowingly and voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to the use of the Company's services. This includes, without limitation, risks of injury, illness, aggravation of condition, disability, permanent damage, medical complications, or death resulting from reliance on advice provided through the platform.
6. The User further acknowledges that medical information evolves continuously and that no warranty or guarantee is made regarding accuracy, completeness, suitability, effectiveness, cure, recovery, or medical outcome. All services are provided strictly on an "as-is" and "as-available" basis without any express or implied warranties, including but not limited to warranties of fitness for a particular medical purpose.
7. The User confirms that all health information, medical history, symptoms, allergies, medications, and other relevant disclosures provided to the Company shall be truthful, complete, and accurate. The User understands that failure to disclose complete or correct information may result in inappropriate or unsafe guidance, for which the Company shall not be held liable.
8. To the fullest extent permitted under applicable law, the User hereby releases, waives, discharges, and agrees to hold harmless the Company from any and all claims, liabilities, demands, damages, actions, causes of action, losses, costs, or expenses (including legal fees) arising out of or related to the use of the services, reliance on advisory guidance, delay in seeking hospital care, misinterpretation of information, or any adverse medical outcome.
9. The User further agrees to indemnify and defend the Company against any third-party claims arising from misuse of the platform, false information provided by the User, failure to obtain emergency treatment, or violation of applicable laws or these terms.
10. The User understands that subscription payments are consideration for access to advisory services only and do not constitute payment for medical treatment. The Company's maximum liability, under any circumstances and regardless of the nature of claim (contract, tort, negligence, or otherwise), shall not exceed the subscription amount paid by the User during the thirty (30) days immediately preceding the event giving rise to the claim.
11. The User confirms that he or she is voluntarily using the platform, has had the opportunity to read this Agreement carefully, understands its legal implications, and agrees to be bound by its terms without coercion or undue influence.
12. If the User is accessing services on behalf of a minor or another individual, the User confirms that he or she is legally authorized to provide consent and assume risk on their behalf.
13. If any provision of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
14. This Agreement shall be governed by the laws of India, and any dispute arising out of or in connection with the use of the platform shall be subject to the exclusive jurisdiction of the competent courts at Samastipur, Bihar, India.

BY CLICKING "I AGREE," REGISTERING, OR USING THE SERVICES, THE USER ACKNOWLEDGES THAT HE OR SHE HAS READ THIS HIGH-RISK WAIVER AND INFORMED CONSENT AGREEMENT, FULLY UNDERSTANDS ITS TERMS, AND VOLUNTARILY ACCEPTS ALL RISKS ASSOCIATED WITH THE USE OF FIRST AID FLEET SERVICES.
